These terms are an agreement between you and Aleksander Petrov Gaup ("we", "us") regarding the use of the Minnehimmel app and its memorial pages ("the service"). By downloading or using the app you accept these terms. If you do not accept them, do not use the service.
Minnehimmel lets you create digital memorial pages for deceased persons, where family and friends can "light a star" with a greeting, and share the page via a QR code or link.
We grant you a limited, non-exclusive, non-transferable right to use the app for personal, non-commercial purposes. You may not copy, decompile, modify or resell the app beyond what the law permits.
Certain features require signing in with "Sign in with Apple". You are responsible for activity on your account. You must be of legal age (18) or have the consent of a guardian to create a paid memorial page.
A published memorial page is a digital service delivered immediately. By completing the purchase you expressly consent to delivery starting at once, and acknowledge that the right of withdrawal is thereby lost, cf. the Norwegian Right of Withdrawal Act (angrerettloven) § 22(n). This does not affect your rights in case of defects under the Digital Services (Consumer) Act.
You must not use the service for unlawful, offensive, threatening or misleading purposes. See our separate content guidelines. Violations may lead to removal of content and exclusion.
The app, its design, source code, logo and the "Minnehimmel" name belong to us and are protected by, among other things, copyright and trademark law. These terms give you no rights to these beyond the license in section 2.
The service is provided "as is". We strive for stable operation but do not guarantee that the service will always be error-free or available. To the extent permitted by law, our liability is limited, and we are not liable for indirect loss or loss of data. Mandatory consumer rights under the Digital Services (Consumer) Act and other non-derogable legislation are not limited by this section.
You may stop using the service at any time and delete your memorial pages. We may terminate access in case of material breach of the terms, with proportionate notice where possible.
We may amend these terms. Material changes will be announced in the app or on minnehimmel.no. Continued use after the changes take effect constitutes acceptance.
This agreement is governed by Norwegian law. Disputes shall preferably be resolved amicably. As a consumer you may always bring a matter before the Norwegian Consumer Authority/Consumer Disputes Committee (Forbrukertilsynet/Forbrukerklageutvalget) and before the courts of your own legal domicile.
